At Outdoor Whisperer, we are committed to delivering soulful, safe, and life-enriching outdoor experiences. However, adventure and experiential travel inherently involve risk and personal responsibility. By booking or participating in any of our journeys, you acknowledge and agree to the terms and risks outlined in this Disclaimer.

1. Assumption of Risk

Participation in any trek, expedition, retreat, workshop, or outdoor travel activity organized by Outdoor Whisperer involves inherent risks, including but not limited to:

  • Physical exertion, fatigue, or muscular strain

  • High-altitude illness or weather-related exposure

  • Injuries due to terrain, wildlife, or equipment failure

  • Risks related to transportation (including road, air, water)

  • Infections, allergic reactions, or illness

  • Psychological or emotional distress

  • In rare cases: permanent disability or death

By participating, you voluntarily accept and assume full responsibility for all such risks, known and unknown.

2. Medical Fitness & Health Declaration

It is your sole responsibility to ensure you are physically and mentally fit for your chosen experience. You confirm that:

  • You have consulted a medical professional for any pre-existing conditions

  • You have disclosed all relevant health conditions, allergies, or recent surgeries to our team

  • You will carry necessary prescribed medication and inform our team about its use

  • You will not participate while under the influence of alcohol, recreational drugs, or sedatives

We reserve the right to refuse participation or remove a participant if their health poses a risk to themselves or the group.

3. Release of Liability

To the fullest extent permitted by applicable law, you agree to release and hold harmless Outdoor Whisperer, its founders, staff, facilitators, and partners from liability for:

  • Any injury, loss, illness, delay, or death arising during the course of the journey

  • Cancellations or changes due to weather, acts of God, political unrest, or operational issues

  • Service lapses by third-party providers (e.g., accommodations, transport, porters)

  • Loss or damage of personal belongings

  • Any risks resulting from the use of equipment (owned or rented)

Despite our commitment to high safety standards, some risks cannot be eliminated entirely.

4. Indemnity

You agree to indemnify and defend Outdoor Whisperer, its staff, and affiliates from any claim, loss, damage, liability, or legal cost arising from:

  • Your actions or misconduct during the journey

  • Failure to follow safety instructions

  • Unauthorized detours or behavior outside the agreed itinerary

  • Negligence, disorderly conduct, or unlawful acts

This indemnity extends to claims brought by third parties affected by your conduct.

5. Third-Party Services

We may contract trusted third-party providers (e.g., transport vendors, lodge operators, local guides). While we select partners with care, we do not control their operations and assume no responsibility for:

  • Service quality or conduct of third-party staff

  • Delays, cancellations, or errors caused by their operations

All services provided by such parties are accepted at your own risk.

6. Personal Responsibility

Each participant is responsible for:

  • Securing and carrying valid travel documents (passport, visa, permits)

  • Maintaining possession and safety of personal items and valuables

  • Ensuring all gear is functional and weather-appropriate (unless rented from us)

  • Respecting local culture, safety guidelines, and group timings

  • Following all instructions from Outdoor Whisperer guides or facilitators

Failure to comply may result in your removal from the program without refund or further liability.

7. Emergency Medical Authorization

In the event of a medical emergency, you authorize Outdoor Whisperer and its team to:

  • Provide or arrange for first aid, medical treatment, or evacuation as necessary

  • Act in good faith to ensure your safety and well-being

You agree to bear all associated costs unless covered by your personal insurance.

8. Media Consent

Outdoor Whisperer may photograph, film, or record parts of the experience for storytelling, educational, or promotional purposes. By participating, you consent to:

  • Use of your image, likeness, or voice in promotional content

  • Distribution of such media on Outdoor Whisperer’s website, social media, or print platforms

If you do not wish to appear in any media, you must inform us in writing before the trip begins.

9. Participation by Minors

Minors (under 18 years of age) may only participate when accompanied by a parent or legal guardian. A separate consent and indemnity form must be signed by the guardian.

10. Binding Effect

This Disclaimer is binding upon you, your heirs, legal representatives, successors, and assigns. It remains in force in the event of injury, disability, or death.

11. Governing Law & Jurisdiction

This Disclaimer is governed by the laws of India. Any disputes arising from participation in our programs shall be subject to the exclusive jurisdiction of the courts in [Your City], India.

  • You voluntarily accept all associated risks

  • You waive all claims against Outdoor Whisperer arising from your participation
